However, it all depends on what happened, and why the driver crashed into you. Truck crashes are complex cases, and there may potentially be multiple liable parties. Generally, the factors the court consider include:<\/p>\r\n\r\n\r\n\r\n<ul class=\"wp-block-list\">\r\n<li>The employee\u2019s intent<\/li>\r\n\r\n\r\n\r\n<li>The nature, time, and place of the employee\u2019s conduct<\/li>\r\n\r\n\r\n\r\n<li>The type of work the employee was hired to do<\/li>\r\n\r\n\r\n\r\n<li>The amount of freedom the employee has to fulfill their job duties<\/li>\r\n\r\n\r\n\r\n<li>The incidental acts the employer should reasonably expect the employee to do<\/li>\r\n<\/ul>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">If the truck driver didn\u2019t act within the scope of their employment at the time of the accident, the court may decide that the trucking company isn\u2019t liable for the wreck.<\/p>\r\n\r\n\r\n\r\n<h3 class=\"wp-block-heading\">When the Employee is Responsible<\/h3>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">There are situations where a company\u2019s insurance won\u2019t cover a driver who causes an accident. If a driver is committing a crime while driving a company vehicle, the employer may refuse to step in to shield the employee from third-party lawsuits.
